**Habanza LLC - Terms and Conditions for Customer Orders**
These Terms and Conditions ("Agreement") govern the placing of orders by customers ("Customer") for clothing and dancewear products from Habanza LLC ("Company"). By placing an order with the Company, Customer agrees to comply with the terms and conditions set forth herein.
**1. Ordering Process:**
- Customers may place orders for clothing and dancewear products through the Company's website, mobile application, or by contacting the Company directly.
- By placing an order, Customer agrees to provide accurate and complete information, including but not limited to billing and shipping address, contact information, and payment details.
**2. Product Availability:**
- All orders are subject to product availability. The Company reserves the right to limit the quantity of products available for purchase.
- In the event that a product is out of stock or unavailable, the Company will notify the Customer and provide alternatives or a refund for the unavailable item.
**3. Pricing and Payment:**
- Prices for products are as stated on the Company's website or mobile application and are subject to change without notice.
- Payment for orders must be made in full at the time of purchase using the payment methods accepted by the Company unless explicitly stated otherwise under circumstances of wholesale orders subject to stated Net Terms in the final Invoice or Sales Quote.
- All payments are processed securely, and Customer's payment information will be treated in accordance with the Company's privacy policy.
**4. Shipping and Delivery:**
- The Company will make reasonable efforts to ship orders promptly after payment confirmation.
- Shipping costs and delivery times will vary depending on the Customer's location and the shipping method selected at checkout.
- The Company is not responsible for delays in shipping or delivery caused by factors beyond its control, such as inclement weather or carrier delays.
**5. Returns and Exchanges:**
- Customer may return or exchange products purchased from the Company within 30 days of receipt, provided that the products are unused, in their original packaging, and accompanied by proof of purchase.
- Returns and exchanges are subject to the Company's return policy, which may be found on the Company's website or provided upon request.
**6. Product Warranty:**
- The Company warrants that its products will be free from defects in materials and workmanship under normal use for a period of one month from the date of purchase.
- This warranty does not cover damage caused by misuse, neglect, accidents, alterations, or improper care of the product.
**7. Intellectual Property:**
- All intellectual property rights in the Company's products, including but not limited to trademarks, copyrights, and designs, are owned by the Company.
- Customer agrees not to reproduce, distribute, or modify the Company's products or any associated intellectual property without the Company's prior written consent.
**8. Limitation of Liability:**
- In no event shall the Company be liable for any indirect, incidental, special, or consequential damages arising out of or related to the purchase or use of its products.
- The Company's total liability for any claim arising under this Agreement shall not exceed the purchase price paid by Customer for the products giving rise to the claim.
**9. Governing Law and Jurisdiction:**
- This Agreement shall be governed by and construed in accordance with the laws of the state of Texas, without regard to its conflicts of law principles.
- Any dispute arising out of or relating to this Agreement shall be subject to the exclusive jurisdiction of the courts of Montgomery County, Texas.
By placing an order with the Company, Customer acknowledges that they have read, understood, and agree to be bound by the terms and conditions set forth herein.
Sizing:
Most of our leotards come in Adult XS-M. We want to add L size and kids sizes so check back often!. Our dance wear is intended to fit snug. For sizing questions, email us at habanzacustomerservice@gmail.com. You’ll love the way our leotards and skirts fit!
